Terms of Service

Effective date: 30 August 2026.

These Terms of Service (“Terms”) are a legally binding agreement between you and the KiloDrive operating entity identified for your country (“KiloDrive,” “we,” “us,” or “our”). They govern your access to and use of the KiloDrive applications, websites, portals, communications, technology, ride marketplace, parcel-delivery marketplace, wallet, memberships, safety tools, and related services (the “Platform”).

Read these Terms carefully. If you do not agree, do not create an account or use the Platform. Country schedules, driver or business agreements, payment terms, promotion rules, community standards, and notices presented for a feature form part of these Terms. Mandatory consumer rights cannot be excluded.

1. KiloDrive’s role

KiloDrive provides technology for requesting, offering, booking, administering, supporting, and recording mobility, parcel, and rental services. The legal role of KiloDrive, the local operator, and the service provider can differ by product and jurisdiction. KiloDrive does not rely on these general Terms to declare every driver an independent contractor, every rental provider a mere listing party, or every transaction a direct customer-provider contract. The approved country and service schedule must identify the applicable contracting and operating roles. KiloDrive does not guarantee that a request will receive an offer or that an enabled marketplace eliminates ordinary transport, rental, or delivery risk.

2. Eligibility and authority

You must be at least 18 years old or the age of legal majority in your country, have legal capacity, and not be prohibited from using the Platform. You may not register as a driver unless you meet every local age, licence, insurance, permit, fitness, and work-authorization requirement. If you act for a company, sole trader, partnership, fleet, or other organization, you confirm that you have authority to bind it; “you” includes that entity.

3. Accounts and security

Provide accurate, current, and complete information and promptly update it. You may maintain only accounts and roles KiloDrive authorizes. Do not impersonate another person, create deceptive or duplicate accounts, transfer an account, allow unauthorized use, or evade a suspension. Keep passwords, devices, passkeys, recovery codes, one-time codes, and sessions confidential. Notify KiloDrive promptly of suspected compromise. You are responsible for activity under your account to the extent permitted by law.

KiloDrive may require phone confirmation, strong passwords, two-factor authentication, device integrity checks, identity verification, or re-verification. A new driver may explore limited app functions before completing onboarding but cannot receive trips until required eligibility steps are satisfied. Failure to set a password within an offered onboarding period may require account recovery.

4. Licence and acceptable use

Subject to these Terms, KiloDrive grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the app and access the Platform for its intended purpose. You may not copy, sell, rent, sublicense, reverse engineer except where law cannot prohibit it, scrape, frame, mirror, circumvent security, probe systems without authorization, automate abusive requests, manipulate bids or ratings, interfere with service, introduce malware, misuse APIs, harvest personal information, or use KiloDrive intellectual property except as expressly permitted.

5. Requests, offers, scheduled services, and assignment

A rider or sender enters the route, stops, timing, service details, accessibility needs where relevant, and proposed fare. Nearby eligible drivers may view the request during its offer window. Drivers may accept or counteroffer where permitted. Offers can expire, be withdrawn, require renewed confirmation after a fare change, or become stale. A request is not confirmed until the customer selects a valid offer and the Platform atomically records the assignment. Simultaneous acceptance attempts may result in one success and one stable conflict response.

Scheduled, recurring, airport, venue-queue, hourly, round-trip, or multi-stop products have additional timing, waiting, reconfirmation, stop, and cancellation rules shown before confirmation. The word guaranteed is used only where a country-approved replacement and support policy is active; otherwise the status will say scheduled, searching, driver reserved, replacement search, or not guaranteed. Estimates of response probability, demand, ETA, or fare range are non-guaranteed and include freshness or confidence context where available.

6. Rides

Participants must verify the displayed driver, rider, vehicle, and plate; use seat belts and legally required restraints; respect occupancy and luggage limits; obey lawful safety instructions; and follow the required trip lifecycle. A driver must not start a trip before the required arrived state and rider PIN or geofence confirmation where enabled, except an authorized and audited administrative override. Drivers must not mark a trip complete early. Riders must not pressure a driver to speed, drive unsafely, carry excess passengers, or violate law.

7. Parcel deliveries

The sender must accurately describe, lawfully possess, securely package, label, and provide authorized pickup and recipient details for every item. Unless expressly supported, do not send illegal, stolen, hazardous, explosive, flammable, toxic, biological, weapon-related, counterfeit, perishable, live, high-value, controlled, cash-equivalent, or privacy-invasive items. Drivers may refuse unsafe, unlawful, misdescribed, oversized, or improperly packaged items. KiloDrive or a provider may inspect, return, store, surrender, or dispose of items where lawful and reasonably necessary. Proof of pickup and delivery, recipient confirmation, and chain-of-custody information may be required.

7.1 Pickup, custody, delivery, and returns

A parcel workflow may require a short-lived pickup or recipient code, signed QR, photographs, signature, declared value, custody events, failed-delivery reason, redelivery, or return to sender. Evidence is limited to the legitimate delivery, safety, dispute, insurance, and legal purposes described in the Privacy Policy. Optional protection is not insurance unless the checkout and approved country disclosure expressly identify a licensed insurance product and provider.

7A. Vehicle rentals

Rental availability, instant-book or approval mode, eligibility, price, taxes, deposit or payment authorization, mileage, fuel, permitted use, service area, insurance or protection, cancellation, no-show, delivery or collection, inspection, extension, late return, damage, maintenance blackout, dispute, and settlement terms must be shown before confirmation. The accepted policy version, quote, evidence checklist, and payment references are snapshotted to the booking. A provider may not use a later policy edit to change an existing booking. Customers and providers must complete accurate pre- and post-rental inspections and preserve relevant evidence.

8. Drivers and driver businesses

Drivers are not guaranteed requests, hours, territory, income, minimum earnings, benefits, or reimbursement unless a mandatory law or approved country agreement says otherwise. The applicable country schedule must state the reviewed driver-business and worker-classification model; these general Terms do not decide that legal status. Subject to local requirements, drivers choose when to go online and which eligible requests to accept, and must maintain all required licences, permits, insurance, registrations, inspections, tax registrations, devices, vehicles, training, and records.

A driver business is responsible for its representatives, beneficial-owner and registration information where required, approved vehicles, insurance, tax and employment or contractor obligations, and ensuring that only the approved driver uses an assigned account. KiloDrive may verify documents, expiry, identity, prior-platform rating claims, business status, and continuing eligibility. Approval can be withheld, restricted, or withdrawn.

9. Driver safety and duty

Drivers must drive attentively, comply with traffic and transport law, maintain a roadworthy clean vehicle, never drive impaired or dangerously fatigued, and stop work when unfit. Country-configured duty windows may warn drivers and block new assignments at a threshold while allowing safe completion of an existing journey. Location, route, incident, and duty records may be used for safety and compliance.

10. Fares, fees, and taxes

The customer’s proposed fare and selected driver offer establish the base service price, subject to disclosed changes for added stops, waiting, route changes, tolls, cancellation, damage, cleaning, taxes, or other authorized adjustments. Before confirmation, review the currency, payment method, estimated route, membership or other platform charges where shown, and applicable conditions. Mapping, traffic, route, and ETA information is an estimate and may be inaccurate or unavailable.

Drivers are responsible for their own expenses and taxes unless law or a country schedule states otherwise. KiloDrive does not deduct a commission from ordinary trip earnings under the published membership model, but may calculate, collect, report, or remit membership fees, withholding, tax, refunds, chargebacks, or another charge where authorized, disclosed, or legally required.

11. Wallet, cash, escrow, memberships, and app-store billing

Wallet balances are recorded in the country currency as integer minor units. A wallet is not described as a bank account, insured deposit, regulated stored-value product, or escrow service unless the approved country disclosure and licensed provider arrangement support that characterization. It does not earn interest and cannot be converted across currencies unless KiloDrive expressly launches a compliant conversion service.

Paid membership is offered only when an active plan, term, country currency, and exact platform store product/base-plan/offer mapping agree. The native store’s localized price and confirmation control the purchase presented on that platform. If a mapping is unavailable or stale, the paid action is disabled rather than inventing a price. Renewal, grace, acknowledgement-pending, restoration, upgrade, downgrade, revocation, refund, and cancellation states are disclosed through the applicable billing surface and mandatory store rules continue to apply.

Wallet rides transfer value according to the recorded settlement. Eligible parcel deliveries may place the accepted fare on hold and release the agreed amount to the driver after valid completion; eligible cancellation releases the hold back to the sender. Cash services record the payment and any disclosed obligations. Immutable ledger references, idempotency keys, and reconciliation controls prevent duplicate financial effects but do not eliminate provider delays.

Driver memberships may set bid, vehicle, visibility, cashout, renewal, or feature limits. Fees, duration, trial eligibility, proration, renewal, grace, and cancellation terms shown at purchase apply. A plan does not guarantee demand or earnings.

12. Top-ups, cashouts, payouts, refunds, and chargebacks

External payment and payout status depends on the relevant provider. KiloDrive may apply minimums, maximums, rolling limits, cooldowns, identity checks, device-risk controls, review, fees, and processing periods. A pending or unknown provider outcome must be reconciled before re-execution. Cashouts may be held pending approval. Rejection returns the hold; approval does not guarantee the receiving institution’s timing. Chargebacks, reversals, refunds, or fraud may create a negative balance or debt where permitted. Masked payout details are displayed; you are responsible for verifying them.

13. Cancellations, no-shows, route changes, and disputes

Cancellation rights and charges depend on service state, timing, conduct, payment method, local law, and the policy shown before booking. A material change to route, stops, passenger count, parcel, waiting time, or destination may require agreement and a price adjustment. Complete-versus-cancel conflicts are resolved from authoritative state, telemetry, ledger, and audit records. Report incorrect charges, non-delivery, damage, misconduct, or safety concerns promptly and provide truthful relevant evidence.

14. Safety, location, communications, and emergencies

KiloDrive provides controls intended to reduce risk, including verification, private document review, phone confirmation, trip sharing, active-trip background location, telemetry freshness, route-change and telemetry-gap checks, chat and calling, duty limits, safety cases, and audit trails. These controls do not guarantee identity, conduct, roadworthiness, service quality, connectivity, emergency response, or safety. KiloDrive is not an emergency service. In immediate danger, contact local emergency authorities first.

Voice or call recording is enabled only where the country policy, provider, consent/disclosure design, retention, private storage, audited access, deletion, and app-store disclosures have been approved. A visible active state must be shown when recording occurs. KiloDrive may preserve relevant trip, location, vehicle, account, communication, or recording evidence for a safety incident, dispute, legal hold, or valid legal request, subject to applicable law.

14A. Family, business, delegated, and assisted travel

Where enabled, every booking identifies the requester, traveler, payer, and any authorized supervisor separately. Family and business managers receive only consent-scoped trip notifications or live tracking and do not automatically gain access to a private rider-driver conversation. Delegated booking, cost-center, policy, receipt, and payment permissions end when revoked or when a member is offboarded. Teen or dependent travel is a separately approved product requiring guardian authority, age and country rules, pickup/drop-off safeguards, scoped supervised communications, retention, and revocation; an ordinary family-member record does not make teen travel available. Assistance profiles are opt-in and disclose only the minimum mobility or communication information needed for an eligible driver to perform the trip.

15. Conduct and non-discrimination

Treat every person with dignity. Harassment, discrimination, threats, violence, sexual misconduct, stalking, retaliation, fraud, coercion, dangerous conduct, weapons contrary to policy or law, property damage, smoking or substance misuse in a vehicle, and interference with safety features are prohibited. Do not use communications for unrelated solicitation or contact another participant after the legitimate service purpose ends.

16. Ratings, communications, and user content

You may submit ratings, messages, photographs, documents, support evidence, and other content. You retain ownership, but grant KiloDrive a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, transmit, analyze, and use that content only as reasonably necessary to operate, secure, improve, support, investigate, promote (with appropriate permission), and comply with law concerning the Platform. You confirm you have the necessary rights and that the content is accurate where required, lawful, relevant, and does not infringe privacy, confidentiality, publicity, or intellectual-property rights.

KiloDrive may restrict or remove content, adjust ratings affected by fraud or abuse, and preserve evidence. Do not record or publish another person without lawful authority. See the Intellectual Property Notice.

17. Promotions, referrals, and reviews

Promotions are limited to their intended audience, country, period, purpose, and account; they have no cash value unless stated and may not be sold, duplicated, publicly distributed, or combined unless allowed. KiloDrive may correct or withdraw a promotion used in error, fraudulently, or contrary to its rules. Store-review prompts may follow positive milestones but do not affect pricing, access, dispute handling, or service priority.

18. Privacy

The Privacy Policy and Cookie Policy explain how information is handled. You must respect information received about another user and use it only to complete the service, address safety, or comply with law. Do not retain, sell, publish, or misuse another person’s location, phone, recipient, trip, or delivery information.

19. Third-party services and devices

The Platform depends on app stores, operating systems, networks, devices, maps, traffic, payment, payout, identity, cloud, communications, and other providers. Their terms may apply. You are responsible for compatible equipment, updates, data access, and carrier charges. KiloDrive is not responsible for independent third-party services, outages, or content, but will use reasonable operational controls and provider recovery procedures.

20. Suspension, investigation, and termination

KiloDrive may warn, limit, pause payments, place funds on hold, require re-verification, deactivate a vehicle, suspend, or terminate access when reasonably necessary for safety, suspected fraud, expired documents, non-payment, legal compliance, abuse, material breach, excessive risk, or protection of users or the Platform. Urgent action may occur without advance notice. Where appropriate and legally required, we will provide a reason and review or appeal route. You may stop using the Platform and request account deletion, subject to outstanding obligations and lawful retention.

21. Platform availability and changes

The Platform is provided on an “as available” basis. Features, countries, providers, service areas, eligibility, and configuration may change. Maintenance, internet conditions, disasters, provider failure, government action, labour disruption, cyber incidents, and other events beyond reasonable control may delay or interrupt service. We do not promise uninterrupted access, a successful match, a particular route, or error-free information.

22. Disclaimers and liability

To the maximum extent permitted by applicable law, KiloDrive disclaims implied warranties not expressly stated, including merchantability, fitness for a particular purpose, and non-infringement. Independent providers are responsible for the transportation or delivery they perform. KiloDrive does not guarantee the conduct, identity, quality, suitability, legality, insurance, or ability of any user or independent provider.

Nothing excludes liability that cannot legally be excluded, including mandatory consumer rights or liability for fraud, wilful misconduct, or personal injury where exclusion is prohibited. Subject to those rights, KiloDrive is not liable for indirect, incidental, special, punitive, exemplary, or consequential loss; loss of profit, opportunity, data, reputation, or business; or loss arising from a transaction between users, third-party service, unauthorized account use, prohibited parcel, or event beyond reasonable control. Any monetary cap must be stated in the applicable country schedule and reviewed under local law; no unstated cap is created by these Terms.

23. Your responsibility and indemnity

To the extent permitted by law, a business user or driver will indemnify KiloDrive and its personnel against third-party claims, penalties, losses, and reasonable costs arising from that user’s unlawful transportation or delivery, invalid licence or insurance, tax failure, prohibited parcel, unauthorized representative, infringement, misuse of personal information, or material breach. This does not require a consumer to indemnify KiloDrive where prohibited by law or for KiloDrive’s own unlawful conduct.

24. Dispute resolution and governing law

Contact support first so we can investigate and attempt an informal resolution. The governing law, court, mediation, arbitration, regulator, consumer forum, and any opt-out right must be specified in the country schedule presented to you. KiloDrive does not impose a universal arbitration or class-action waiver through these general Terms. Nothing prevents urgent injunctive relief, a report to an authority, or use of a mandatory consumer process.

25. General terms

You may not assign these Terms without consent; KiloDrive may assign them as part of a reorganization or transfer of the relevant service, subject to law. If a provision is unenforceable, it is limited or removed only to the minimum extent and the remainder continues. Failure to enforce is not a waiver. Headings aid reading only. Electronic notices and acceptance are valid where law permits. These Terms and incorporated supplemental terms are the entire agreement concerning the Platform, except a separate signed agreement.

26. Changes and contact

We may update these Terms for legal, safety, operational, or product reasons. Material changes will be notified and take effect prospectively after any required notice or renewed consent.
